U.S.C. - TITLE II
Enforcement and Jurisdiction of Federal Law



§1. DEFINITIONS

a.) "Federal law" is defined as:

i.) The Constitution of the United States.
ii.) The Code of Laws of the United States.
iii.) Legislation enacted by the United States Congress.
iv.) Decisions enacted by a federal court.


b.) Per the Constitution, federal law takes precedence over all state laws and municipality bylaws, and applies to all states and territories within the United States of America, and on any official or diplomatic property of the United States Government, be it on home or foreign soil.

c.) "Federal law enforcement" is defined as:

i.) Any agency established, authorized and designated to conduct enforcement of federal law by the U.S. Code.
ii.) Any sworn employee of any official federal law enforcement agency undertaking official law enforcement duties throughout the United States.



§2. ENFORCEMENT OF FEDERAL LAW AND COMPLIANCE WITH STATE LAW

a.) Per this Title, federal law may only be enforced by an authorized and designated federal law enforcement agency and/or a federal court.

b.) Where actions of federal law enforcement infringe upon, or are otherwise obstructed by, any state law or municipality bylaw, said law shall be displaced to protect federal interests or enforce federal law.

c.) Pursuant to U.S.C. Title II, Section 2, Sub-Section A, no state agency or judiciary may charge or prosecute a federal law enforcement officer.

d.) Pursuant to U.S.C. Title II, Section 2, Sub-Section A, and U.S.C. Title II, Section 2, Sub-Section C, any state law enforcement agency must release any detained federal law enforcement officer and file an official report to the federal agency responsible for said officer.


§3. JURISDICTION OF FEDERAL COURTS

a.) A trial falls under the jurisdiction of, and is tried by, a federal court when one or more of the following circumstances apply:

i.) Where an alleged crime or crimes are a violation of federal law.
ii.) Where an alleged crime or crimes are committed across state lines or otherwise extend to multiple jurisdictions.
iii.) Where an alleged crime or crimes are committed within international waters over which the United States has jurisdiction.
iv.) Where an alleged crime or crimes are committed on any official property of the United States Government, such as an embassy, post office, or airport.



§4. REPRESENTATION OF THE UNITED STATES BEFORE A JUDICIARY

a.) Per this Title, the Attorney-General of the United States shall be permitted to represent the United States before a federal judiciary, be it in a prosecutorial or defensive capacity, on behalf of the United States Department of Justice. By extension, this permission shall extend to any sworn employee of the United States Department of Justice acting on behalf of, or otherwise representing, the Attorney-General of the United States.

b.) The United States Congress shall, by an Act of Congress, be authorized to appoint a federal agency, special counsel or other legal representative, to represent the United States before a federal judiciary, be it in a prosecutorial or defensive capacity.

c.) A federal agency shall be permitted to represent the United States before a federal judiciary, be it in a prosecutorial or defensive capacity, through their internally and officially appointed prosecutor(s) where the following circumstances apply:

i.) The prosecutor(s) are appointed by, and serve at the pleasure of, the head of that agency, in an interim or permanent capacity.
ii.) Pursuant to U.S.C. Title II, Section 4, Sub-Section A, upon appointment, said prosecutor is thereby a federal prosecutor with authority to represent and/or otherwise act on behalf of the United States before a federal judiciary, until their tenure ends, per the head of that agency.
