SAN ANDREAS GOVERNMENT CODE
TITLE I — GENERAL PROVISIONS



Section 1: Citation and Purpose

Article 1: This Act shall officially be cited as the "San Andreas Government Code" or "S.A. Government Code."

Article 2: The purpose of this Code is to establish the structure, powers, duties, and administration of the government of the State of San Andreas and its public agencies.

Article 3: This Code shall be interpreted in a manner consistent with the Constitution of the United States and the Constitution of the State of San Andreas.



Section 2: Authority of the State

Article 1: The State of San Andreas possesses all governmental authority not prohibited by the Constitution of the United States or otherwise preempted by federal law.

Article 2: State governmental authority includes the power to:


  • A. Enact and enforce laws.
  • B. Maintain public order and safety.
  • C. Regulate public agencies and officers.
  • D. Administer taxation, licensing, and public services.
  • E. Establish courts, departments, commissions, and public institutions as authorised by law.

Article 3: No provision of this Code shall be interpreted to authorise conduct prohibited under federal constitutional law.



Section 3: Public Offices and Agencies

Article 1: Public offices, agencies, departments, boards, commissions, and authorities created pursuant to law shall possess only those powers lawfully granted to them.

Article 2: Public officials and employees shall exercise their authority in good faith and within the lawful scope of their office or employment.

Article 3: Government agencies may adopt lawful rules, regulations, policies, and procedures necessary to carry out their official duties where authorised by law.

Article 4: Nothing within this Code shall prevent the establishment of additional departments or agencies by lawful legislative or executive action.



Section 4: Public Officers and Employees

Article 1: A public officer or employee is any person lawfully appointed, elected, employed, commissioned, or authorised to perform governmental duties on behalf of the State of San Andreas or any political subdivision thereof.

Article 2: Public officers and employees remain subject to:

  • A. Applicable federal and state law.
  • B. Lawful departmental policies and regulations.
  • C. Administrative oversight and disciplinary authority.

Article 3: Public employment shall not exempt any person from criminal liability for unlawful conduct.



Section 5: Official Acts and Scope of Authority

Article 1: Official acts performed by public officers and employees under lawful authority shall be presumed valid unless determined otherwise by a court or competent authority.

Article 2: Acts performed outside the lawful scope of authority shall not be protected solely by virtue of governmental office or employment.

Article 3: A public officer or employee who knowingly exceeds lawful authority may be subject to administrative, civil, or criminal liability pursuant to law.



Section 6: Cooperation Between Agencies

Article 1: State, county, municipal, and special district agencies may cooperate and share resources for lawful governmental purposes.

Article 2: Government agencies may enter into mutual aid agreements, interagency agreements, or task force arrangements where authorised by law.

Article 3: Nothing within this Section shall limit the lawful authority of federal agencies operating within the State of San Andreas.



Section 7: Interpretation and Construction

Article 1: The provisions of this Code shall be interpreted to promote lawful, efficient, and constitutional government administration.

Article 2: If any provision of this Code is determined invalid or unconstitutional, the remaining provisions shall remain in full force and effect to the maximum extent possible.

Article 3: Headings, titles, and section labels are provided for organisational purposes and shall not alone determine substantive legal meaning.
