U.S.C. - TITLE XI
Department of Defense and Armed Forces
§1. ESTABLISHMENT OF THE DEPARTMENT OF DEFENSE
a.) The Department of Defense (DoD) is hereby established as an executive department of the United States Government.
b.) The Department of Defense shall be headed by the Secretary of Defense, appointed in accordance with federal appointment procedures and serving under the authority of the Executive Branch.
c.) The Department of Defense shall exercise civilian oversight and administrative control over the Armed Forces of the United States.
§2. ESTABLISHMENT OF THE ARMED FORCES
a.) The Armed Forces of the United States are hereby established as the unified military forces of the United States of America.
b.) The Armed Forces shall consist of such branches as may be established or recognised under federal authority, including but not limited to land, naval, air, and special operations components.
c.) All members of the Armed Forces serve under a lawful chain of command ultimately directed through the Department of Defense, the Executive Branch, and the President of the United States in their constitutional capacity as Commander-in-Chief of the Armed Forces.
§3. MILITARY JURISDICTION AND FEDERAL AUTHORITY
a.) The Armed Forces shall operate under federal jurisdiction and authority in matters of national defence, security, and federal operations.
b.) Military jurisdiction applies to:
i.) Federal military installations and defence facilities.
ii.) Federal government property designated for military use.
iii.) Lawful overseas or extraterritorial operations authorised by the United States Government.
c.) The Armed Forces shall not exercise general law enforcement authority within civilian jurisdiction except where explicitly authorised under federal law or lawful executive emergency directive.
§4. CIVILIAN AUTHORITY AND LIMITATIONS
a.) The Armed Forces shall remain subordinate to civilian authority exercised through the Executive Branch and Congress.
b.) The Armed Forces shall not supersede or replace federal law enforcement agencies in the enforcement of federal criminal law unless expressly authorised under federal statute or executive emergency powers.
c.) Nothing in this Title shall be interpreted as granting the Armed Forces independent judicial, prosecutorial, or policing authority within civilian jurisdiction.
§5. EXECUTIVE DEPLOYMENT AUTHORITY
a.) The Armed Forces may be deployed domestically or internationally only under lawful authority granted by the President or authorised executive directive.
b.) Deployment may occur in circumstances including, but not limited to:
i.) National defence and/or security operations.
ii.) Response to terrorism or threats to national security.
iii.) Federal emergency or disaster response.
iv.) Protection of federal assets, infrastructure, or personnel where authorised.
c.) The Armed Forces may operate in support of federal law enforcement agencies where expressly authorised by executive order, federal statute, or lawful joint operational directive, including temporary integration under unified command structures for defined operations.
d.) All deployments shall remain subject to applicable federal law and oversight.
§6. FEDERAL MILITARY INSTALLATIONS AND RESTRICTED AREAS
a.) Federal military installations and defence facilities are designated federal properties operated under the authority of the Department of Defense.
b.) Access to such facilities may be restricted or regulated under federal authority for reasons including security, operational integrity, or national defence.
c.) Designation, classification, and regulation of specific military installations and restricted areas shall be governed under federal regulations and authorised executive directives.
