U.S.C. - TITLE VI
Crimes Against Persons and Federal Interests



§1. ASSAULTS AGAINST FEDERAL PERSONNEL

a.) A person commits an offence where they knowingly assault, intimidate, threaten, or interfere with a federal official performing official duties.

b.) Punishment:

i.) Simple assault or intimidation — Up to 5 years imprisonment.
ii.) Aggravated assault involving weapons or bodily harm — 5–20 years imprisonment.

c.) Retaliation against a federal official, witness, or informant through violence, threats, kidnapping, or attempted murder shall carry penalties of no less than 5 years and up to life imprisonment.




§2. TORTURE AND UNLAWFUL DETENTION

a.) A person commits torture where they intentionally inflict severe physical or mental pain upon another person while exercising custody or control over them.

b.) Punishment: Imprisonment for no less than 15 years and up to life imprisonment.

c.) This section applies regardless of whether the offender acts under colour of law or private authority.




§3. KIDNAPPING AND HOSTAGE TAKING

a.) A person commits kidnapping where they unlawfully seize, transport, detain, or confine another person against their will.

b.) Federal jurisdiction applies where:

i.) Interstate or international transport occurs.
ii.) A federal official or protected witness is involved.
iii.) The offence is connected to organised crime, terrorism, or trafficking.

c.) Punishment: Imprisonment for no less than 10 years and up to life imprisonment.




§4. FUGITIVES AND EVASION OF JUSTICE

a.) A person commits an offence where they knowingly assist, conceal, transport, or harbour a wanted fugitive or escaped prisoner.

b.) Punishment: Imprisonment for no less than 5 years and no more than 15 years.

c.) A person who flees the jurisdiction of the United States to evade prosecution or testimony in a federal matter may be declared a federal fugitive.

d.) Upon extradition or return, punishment may include imprisonment for no less than 5 years and no more than 20 years.




§5. WITNESS TAMPERING AND RETALIATION

a.) A person commits witness tampering where they knowingly intimidate, threaten, influence, coerce, or attempt to improperly influence any of the following, in connection with a federal investigation or proceeding:

• A witness.
• A victim.
• An informant.
• A cooperating individual.

b.) Prohibited conduct includes:

• Threats of violence or harm.
• Coercion or intimidation.
• Bribery or inducement.
• Retaliation for cooperation with authorities.

c.) Punishment:

i.) Base offence — 2–10 years imprisonment.
ii.) Aggravated offences involving violence, kidnapping, or organised crime — Up to life imprisonment.




§6. PERJURY AND FALSE STATEMENTS

a.) Perjury

i.) A person commits perjury where they knowingly provide materially false testimony under oath during a federal proceeding.

ii.) Punishment: Imprisonment for no less than 2 years and no more than 10 years.

b.) False Statements

i.) A person commits an offence where they knowingly falsify, conceal, or provide materially false information or documentation to the United States Government or a federal agency.

ii.) Punishment:

• Up to 5 years imprisonment and/or fines.
• Up to 10 years imprisonment where national security, terrorism, or corruption investigations are affected.




§7. SOLICITATION, ACCOMPLICE LIABILITY, AND ACCESSORY

a.) Solicitation

i.) A person commits solicitation where they intentionally encourage, request, or direct another person to commit a federal offence.

ii.) Punishment shall not exceed the maximum penalty for the solicited offence.

b.) Accomplice Liability

i.) A person who knowingly assists or facilitates the commission of a federal offence shall be criminally liable as a principal offender.

c.) Accessory Before the Fact

i.) To aid, plan, or encourage a federal offence prior to its commission.

d.) Accessory After the Fact

i.) To knowingly assist another person in avoiding arrest, prosecution, or punishment after the commission of a federal offence.

ii.) Punishment under this section may be reduced relative to the principal offence based on involvement.




§8. ENTRAPMENT AND OFFICIAL MISCONDUCT

a.) Entrapment occurs where a law enforcement official induces another person to commit an offence through coercion, threats, violence, blackmail, or unlawful pressure.

b.) Lawful undercover operations and opportunity-based investigations do not constitute entrapment.

c.) Any law enforcement official who unlawfully entraps another person commits official misconduct.

d.) Punishment: Imprisonment for no less than 3 months and no more than 5 years, and removal from office where applicable.
